Rules for exchanging or returning goods
1. Exchange and return of goods of proper quality
According to Article 9 of the Law of Ukraine “On Protection of Consumer Rights”
(https://zakon.rada.gov.ua/laws/show/1023-12 ), the buyer may apply for an exchange of
goods of proper quality for a similar one (of a different size, color, shape)
within 14 days (excluding the day of purchase) or return it, receiving the full
cost. Mandatory conditions for exchange/return:
– the product has not been used, its commercial appearance and consumer
properties have been preserved,
– all seals, labels, branded packaging, etc. are present,
– there is a payment document, a check.
If at the time of exchange a similar product is not available for sale, the consumer has the right:
– within 14 days to purchase any other products from the available range with an appropriate recalculation of the cost,
– to exchange the product for a similar one when the desired model first goes on sale, if this is possible within 2 months,
– within 7 days to receive a refund in the amount of the cost at the time of purchase.
In the event of disputes in assessing the condition of the product, the store has the right to order an expert examination at its own expense. If the seller’s doubts are officially confirmed, the client reimburses the cost of expert services and loses the right to return or exchange the product.
Goods of proper quality that are not subject to exchange and return
According to the list approved by the Cabinet of Ministers of Ukraine, goods of proper quality from the following categories are not subject to return and exchange:
– feather and down products (pillows, fillers)
– bed linen
– tulle and lace fabrics
– plate materials, rolled metal and glass, cut or cut to the size specified by the client (panels, kitchen surfaces, metal bases).
Reserving the right of refusal, BENYA & ZUBRIK may meet the client and
discuss the return and exchange of some categories from this
list (except for personal items from the first two items) on an individual basis.
2. Exchange and return of goods of improper quality
According to Art. 8 of the Law of Ukraine “On Protection of Consumer Rights” in case of detection of defects
within 14 days (or during the warranty period), the consumer has the right
to demand:
– a proportional reduction in the price,
– free elimination of defects,
– reimbursement of the costs of eliminating the defect,
– replacement with the same product or a similar one available from the seller,
– return of the product and compensation for the amount paid for it.
If replacement is impossible, the consumer has the right to choose any
option for compensation from the above list. When replacing the product with a similar one,
in the event of a price change, the cost is not recalculated.
Terms of exchange/compensation of goods of inadequate quality
Requirements for free elimination of defects or replacement of poor-quality goods must
be satisfied within 14 days from the date of its presentation or by agreement of the parties.
If the assortment is available, the replacement of poor-quality goods is carried out immediately, and if it is necessary to check the quality – within 14 days or by agreement of the parties.
In the event of the absence of goods, the requirement for its replacement must be satisfied within two months from the date of submission of the application.
3. Procedure for returning goods
3.1 The client sends an application of the established
sample to the email address bentsyanovskyy@ukr.net – for goods of proper or improper quality.
3.2 As soon as possible, a company representative contacts the buyer to clarify all the details and confirm the consent of both parties to the exchange/return.
3.3 The returned goods are delivered to the store: in case of proper quality of the products – at the expense of the buyer, in case of poor-quality assortment – at the expense of the company BENYA&ZUBRIK.
3.4 After the goods are returned to the store and their condition is confirmed, a refund or replacement with another model (at the customer’s request) is made, on the terms specified in the rules, respectively: for products of proper or improper quality.
